CouncilConnect Website Disclaimer and Indemnity

The CouncilConnect website (the Website) contains information, graphics and materials (the Material) prepared by the Local Government Association of Tasmania (LGAT).

This Disclaimer applies to the use of the Material and the Website by you or any person, corporation or other entity to whom you communicate the Material (jointly and severally referred to as the User). In accessing the Website and the Material, the User agrees to be bound by this Disclaimer. If you do not accept to be bound by this Disclaimer, you must refrain from accessing or using the Website and the Material.

The Material is general in nature and cannot be relied upon as legal or other advice. The Material has been made available for general use only and is provided without any express or implied warranty as to its accuracy or currency. It is made available on the understanding that the User exercises their own skill and care with respect to its accuracy, effect and currency, for which purpose LGAT recommends you seek independent legal advice.

The LGAT disclaims, to the fullest extent permitted by law, any liability whatsoever and howsoever arising, in relation to, or arising out of the Website or the quality, accuracy and/or currency of the Material. For reasons of succinctness and presentation, the Material may be in the form of summaries and generalisations and may omit details that could be significant in a particular context or to particular persons.

The Website and the Material is made available on the understanding that the LGAT and its respective officers, employees and agents will have no liability (including but not limited to liability by reason of negligence) to any person in respect of all claims, loss, damage, suits, fines, penalties, expenses or other costs whatsoever or howsoever caused, whether direct, indirect, consequential or special, in relation to, or arising out of, any person using or relying on the Website or the Material regardless of whether caused by reason of any error, omission or misrepresentation in the Material or any reason whatsoever or howsoever caused.

To the fullest extent permitted by law, the User agrees to indemnify and hold harmless the LGAT, its officers, employees and agents from and against all claims, losses, damage, suits, fines, penalties, expenses or other costs whatsoever or howsoever caused, whether direct, indirect, consequential or special, including legal fees, in relation to, or arising out of, the User’s use of the Website or the Material.

Any links to other websites that have been included on the Website are provided for your convenience only. These external information sources are outside the control of the LGAT. It is the responsibility of Users to make their own decisions about the accuracy, currency, reliability and correctness of the information on those sites. The LGAT disclaims, to the extent permitted by law, any liability whatsoever, howsoever caused, in relation to, or arising out of, the quality, accuracy and/or currency of the information available on those third party websites.

The LGAT gives no warranty that the Website or the Material is free of infection by computer viruses or other contamination, nor that access to the Website or any part of it will not suffer from interruption from time to time without notice.
